Disability And The Law:  Critical Perspectives On Disability Rights And Legislation

This course examines disability rights legislation, exploring the trajectory from civil rights to human rights frameworks, and critical interdisciplinary insights relating to the study of disability. In this course, students will scrutinize the historical, theoretical, and conceptual frameworks that underpin legislative approaches to disability rights. Critical perspectives examined in the course include: feminist and critical race analyses of disability legislation, disability studies debates around legal definitions and interpretations of disability, and legal scholarship on evolving trends in disability rights jurisprudence. Students will examine a number of key court cases involving disability rights challenges in Canada, the United States and Britain with respect to issues such as accessibility and accommodation, income replacement, social support policies, health rights (including the topic of euthanasia) and disabled women’s reproductive rights.
